Article 1: GENERAL PROVISIONS
1.1 Air Djibouti will provide carriage for passenger named in the Ticket and passenger maybe asked to produce appropriate identification if required.
1.2 Air Djibouti Ticket is not transferable.
1.3 Tickets sold at discounted fares could be partially or completely non-refundable except for certain taxes.
1.4 Fully unutilized tickets are refundable without penalty when passenger are prevented from travelling by Air Djibouti due to technical or operational reasons or due to Force Majeure provided that the passenger promptly advise us and submit request for refund.
1.5 Passenger shall not be entitled to be carried on a flight unless provide valid identification and a valid Electronic Ticket.
1.6 The ticket is valid only for the transportation as shown on the Ticket, from the place of departure via any transit stop places to the final destination. The fare passenger have paid is based upon our Tariff and is for the transportation as shown on the Ticket. It forms an essential part of our contract with passenger
1.7 Passenger ticket is valid only if utilized in sequence provided on the ticket. Any variation to travel sequence will result into denied acceptance for carriage or recalculation of fare for issuance of new ticket, if so required by the passenger, with cost charged to the passenger. Should passenger be required to change any aspect of ticket due to Force Majeure, he/she must contact us soon as possible where Air Djibouti will put all reasonable efforts to assist him/her in this regard without any penalty charges
1.8 Changing travel itinerary for some types of ticket may not result in a change of fare while for others, may result increase in fare price, which shall be charged to the passenger. Certain fares are valid only for the dates and for the flights shown on the Ticket and may not be changeable or only upon payment of an additional fee.
1.9 Each passenger ticket will be accepted for carriage only in the class of service and for the date and flight for which space has been reserved.
1.10 In the event passenger do not show up for any flight, passenger subsequent flight reservations will not remain valid. Subsequent reservations and/or revalidation of the ticket may require additional fare, charges, fees and penalties. Air Djibouti will not carry passenger until payment made for the revised fare and applicable penalties by the passenger. If the revised fare is less than the original fare paid, Air Djibouti will refund the difference, less any applicable administration fee(s) and penalties.
Article 2: Fares, Taxes, Fees, Penalties and charges
2.1 FARES. Fares charged for transportation only apply for carriage from the airport at the point of origin to the airport at the point of destination, unless otherwise expressly stated. Fares do not include ground transportation service between any point, airport or terminal. Passenger fares are calculated in accordance with our Tariff in effect on the date of payment of passenger ticket for travel on the specific dates and itinerary shown on it. Any changes in itinerary or dates of travel required by the passenger after ticket issuance may apply additional fare charges to be paid by the passenger. Tickets purchased on promotional fares are non-refundable/changeable unless specified.
2.2 TAXES, FEES AND CHARGES
2.2.1 Taxes, fees and charges imposed by government or other authorities, or by the operator of an airport, shall be payable by passenger at the time of ticket issuance. Any additional taxes, fees or charges may be applied by the government or other authorities or airport operators separately and may be asked for payment directly or indirectly at the time of check-in at the airport. The taxes, fees and charges imposed on air travel are constantly changing and can be imposed after the date of Ticket issuance. In an event of increase in a tax, fee or charge shown on the Ticket, application of new tax, fee or charges by the competent authorities, government or airport operators, the passenger will be obliged to pay it before travel. Similarly, in the event any taxes, fees or charges which passenger have paid to us at the time of Ticket issuance are abolished or reduced such that they no longer apply to passenger, or a lesser amount is due, passenger will be entitled to claim a refund.
2.2.2 Fully unutilized tickets sold on regular fare are refundable less reasonable service fee. Partially unutilized tickets sold on regular fare are refundable after deductions of fare of the sector flown and application of reasonable service fee.
2.3 CURRENCY Fares, taxes, fees and charges are payable in the currency of the country in which the Ticket is issued, unless another currency is indicated at or before the time of payment. Air Djibouti may at its discretion, accept payment in other currencies.
Article 3: Reservations
3.1 RESERVATION REQUIREMENTS
3.1.1 Air Djibouti or its Authorized Agent will record passenger reservation(s) and shall provide passenger with written confirmation of passenger reservation(s).
3.1.2 Certain fares have conditions, which limit or exclude passenger right to change or cancel reservations.
3.1.3 All bookings and seat reservations are time bound and shall be cancelled if the ticket is not purchased before specified ticketing time limit as advised by Air Djibouti or its Authorized Agent.
3.1.4 Passengers, at the time of reservation, are required to give their valid phone contact and/or email address to the booking agent, which shall be added in their booking reference. This will help Air Djibouti or its agents to timely inform passenger of any deviation to flight schedule, if any, for passenger convenience.
3.2 PERSONAL DATA Passenger understand that his/her personal data has been given to us for the purposes of making a reservation for ticket purchase. This data may therefore be disclosed to third party service providers who may send marketing emails or text messages on our behalf to the passenger regarding goods and/or services for the interest of passenger, obtaining ancillary services, developing and providing services, facilitating immigration and entry procedures, and making available such data to government agencies, in connection with passenger travel. For these purposes, passenger authorize us to retain and use such personal data and to transmit it to our own offices, Authorized Agents, third party service providers, government agencies and other Carriers involved in the ticketing or travel. Air Djibouti is committed to protect passenger personal data and privacy. For details of the basis upon which Air Djibouti may collect, process and transfer passenger personal data, please refer to our privacy policy in Article 17 below
3.3 SEATING Air Djibouti will endeavor to honor advance seating requests; however, Air Djibouti cannot guarantee any particular seat. Air Djibouti reserve the right to assign or reassign seats at any time, even after boarding of the aircraft. This may be necessary for operational, safety or security reasons.
3.4 RECONFIRMATION OF RESERVATIONS
3.4.1 Onward or return reservations may be subject to the requirement to reconfirm the reservations within specified time limits. Air Djibouti will advise passenger when Air Djibouti require reconfirmation, and how and where it should be done. If it is required and passenger fail to reconfirm, Air Djibouti may cancel passenger onward or return reservations. However, Air Djibouti may reinstate reservation if passenger wishes so subject to availability of seats and payment of additional fare and penalty amount, if any. In the event of no seats available on same flight, Air Djibouti will endeavor to transport passenger on earliest available flight
3.4.2 It is passenger’s responsibility to check the reconfirmation requirements of any other Carriers involved in passenger’s journey. Where it is required, passenger must reconfirm with the Carrier whose code appears on his/her ticket.
Article 4:Check-in and boarding
4.1 Check-in closing times are different at airports and Air Djibouti recommend that passenger make themselves aware about these Check-in closing times and honor them for smooth check-in process. Air Djibouti reserve the right to cancel passenger reservation if passenger does not comply with the Checkin Deadlines and shall be considered no-show. Air Djibouti or our authorized agents will advise passenger of the Check-in Deadline of their respective airport of departure. For any subsequent flights departures in journey, passenger should seek check-in deadlines information at the time of booking. Check-in Deadlines for our flights may be obtained from Air Djibouti or its authorized agents. If no time indicated then generally the Check-in closing time is 1 hour before the published departure time..
4.2 Passenger are required to be present at the boarding gate no later than the time specified by us at the time of check-in. This time will normally printed on passenger boarding pass but may be changed by public announcement or otherwise
4.3 Air Djibouti may cancel the space reserved for passenger if passenger fail to report to the boarding gate in time and shall be considered no-show
4.4 Air Djibouti will not be liable to passenger for any loss or expense incurred due to passenger failure to comply with the provisions of this Article.
Article 5: Refusal and limitation of carriage
5.1 RIGHT TO REFUSE CARRIAGE In the reasonable exercise of our discretion, Air Djibouti may refuse to carry passenger or passenger Baggage if Air Djibouti have notified passenger in writing that Air Djibouti would not at any time after the date of such notice carry passenger on our flights. In such cases passenger will be entitled for refund of his/her ticket fare paid. Air Djibouti may also refuse to carry passenger or passenger Baggage without any obligation on any flight even if passenger holds a valid Ticket and have a boarding pass if one or more of the following have occurred or Air Djibouti reasonably believe may occur:
5.1.1 Such action deemed necessary in order to comply with any applicable government laws, regulations, or orders;
5.1.2 The carriage of passenger and / or passenger Baggage may endanger or affect the aircraft, property and/or safety, health, or affect the comfort of other passengers or crew;
5.1.3 Passenger mental or physical state, including passenger impairment from alcohol or drugs, presents or appears to present a hazard or risk to passenger itself, to other passengers, to crew, to the aircraft or to property;
5.1.4 Passenger have refused to submit to a security check for self or his/her Baggage or fail to provide satisfactory answers to security questions at check-in or at the boarding gate, or passenger fails a security profiling assessment / analysis, or any tempering found on passenger’s travel document including but not limited to passport, tickets, boarding pass and health documents;
5.1.5 Passenger have not paid the applicable fare, taxes, fees or charges;
5.1.6 Passenger do not appear to have valid or lawfully acquired travel documents or refuse to surrender travel documents to the flight crew, against receipt, when so requested;
5.1.7 Passenger present a Ticket that has been or appears to have been acquired unlawfully, has been purchased from an entity other than Air Djibouti or its authorized agent or is a counterfeit.
5.1.8 Passenger fails to comply with the requirements set forth in Article 1.7 above concerning coupon sequence and use, or passenger present a Ticket which has been issued or altered in any way, other than by Air Djibouti or its Authorized agent, or the Ticket is expired;
5.1.9 Passenger fails to observe or obstruct or hinder our instructions with respect to safety or security, whether prior to boarding or on board the aircraft, or those of any ground staff or crew member in the performance of their duties or if passenger tamper or threaten to tamper with the aircraft, its equipment or any part thereof;
5.1.10 Passenger use threatening, abusive or insulting words or behave in a threatening, abusive or insulting manner towards Air Djibouti, its staff, ground staff or members of the crew or towards other passengers;
5.1.11 Passenger fails to observe our instructions relating to safety, security or other passengers comfort, such as but not limited to seating, storage of Unchecked Baggage, smoking, consumption of alcohol, use of drugs or use of electronic equipment and devices which are prohibited during the flights;
5.1.12 Passenger fails, or refuse, to give us information in passenger possession or available to passenger which a governmental authority has lawfully asked us to provide about passenger;
5.1.13 Passenger has been put on travel ban by security or by governmental or any other competent authority;
5.1.14 Passenger have previously committed any one of the acts or omissions referred to above
5.2 CONSEQUENCES OF REFUSAL TO CARRY OR REMOVAL OF PASSENGER. If Air Djibouti have, in the exercise of our reasonable discretion, refused to carry passenger, or removed passenger en-route, for any of the reasons mentioned in Article 5.1 above, then Air Djibouti may cancel any remaining unused portion of the Ticket. Passenger will not be entitled to further carriage or to any refund with respect to any of the sectors covered by the Ticket and Air Djibouti will not be liable for any consequential loss or damage alleged due to any such refusal to carry or removal.
5.3 SPECIAL ASSISTANCE. Subject to the provisions of EC Regulation 1107/2006 on the rights of disabled persons and persons with reduced mobility when travelling by air, where applicable, acceptance for carriage of unaccompanied minors, incapacitated or disabled persons or persons with reduced mobility, pregnant women, persons with illness or other people requiring special assistance is subject to prior arrangement with us. The carriage of such passenger may be denied at the time of boarding should their physical condition has changed, worsen or likely to be worsened during the flight.
5.4 GROUND SERVICES
5.4.1 Air Djibouti do not make any arrangements unless specified or guarantees provision / availability of equipment and services on the ground at airports including fast track services, porter service, airport lounges and the facilities available within these lounges or any of such kind of services.
5.4.2 Wheelchair service charges varies at different airports while it is provided free of cost at some others. Passengers are required to check such charges at the time of ticketing or at the check-in counters.
Article 6:Baggage
6.1 FREE BAGGAGE ALLOWANCE. Passenger may carry some Baggage free of charge subject to our conditions of carriage and limitations. This information can be obtained from Air Djibouti booking offices or from our authorized agents
6.2 EXCESS BAGGAGE. Passenger will be required to pay a charge for carriage of Baggage in excess of the free Baggage allowance. These rates are available at the Air Djibouti booking office or at the check-in counters. For onward carriage on other carrier, passenger should obtain the information from those carriers.
6.3 PROHIBITED ITEMS AND ITEMS UNACCEPTABLE AS BAGGAGE
6.3.1 Passenger must not include in passenger Baggage:
6.3.1.1 Items, which are likely to endanger the aircraft, persons, or property on board the aircraft. These are specified in the International Civil Aviation Organization (ICAO) Technical Instructions for the Safe Transport of Dangerous Goods by Air and by the International Air Transport Association (IATA) Dangerous Goods Regulations;
6.3.1.2 Items, which are prohibited to carry by the applicable laws, regulations or orders of any state to be flown from, over or to;
6.3.2 Firearms and ammunition other than for hunting and sporting purposes are prohibited from carriage as Baggage. Firearms and ammunition for hunting and sporting purposes may be accepted without liability, as Checked Baggage with prior approval from airport security and the carriers mentioned in the ticket. Firearms must be unloaded with the safety catch on, and suitably packed. Carriage of ammunition is subject to ICAO and IATA regulations as referred in 6.3.1.1 above;
6.3.3 Air Djibouti at its sole discretion, can deny carriage of any item into the cabin, which is forbidden by law, or on a belief that its presence in the cabin will negatively affect safety or security of the aircraft, the crew, the other passengers or the property
6.3.4 Passengers are forbidden to carry swords, knives, blades, archery bows, arrows, scissors or similar items into the aircraft cabin.
6.3.5 Air Djibouti may either tell passenger to check-in items referred to in clauses 6.3.3 and 6.3.4 as Checked Baggage or refuse to carry them altogether.
6.3.6 Passenger must not include in Checked Baggage money, jewelry, precious metals, precious stones, gold, silverware, computers, laptops, personal electronic devices (including but not limited to mobile communication devices, gaming devices, tablets and iPads or equivalent), negotiable papers, securities or other valuables, business documents, passports, travel documents and other identification documents or samples.
6.3.7 If, despite being prohibited, any items referred to in 6.3.2, 6.3.3, 6.3.4 and 6.3.6 are included in passenger Baggage, Air Djibouti shall not take any liability for any loss or damage to such items.
6.4 RIGHT TO REFUSE CARRIAGE.
6.4.1 Air Djibouti at its sole discretion can refuse to carry as Baggage the items described in 6.3, and Air Djibouti may refuse further carriage of any such items upon discovery
6.4.2 Air Djibouti may refuse to carry as Baggage any item reasonably considered by us to be unsuitable for carriage because of its nature, weight, size and shape, content, character, or for safety or operational reasons, or the comfort of other passengers, or because they are fragile or perishable.
6.4.3 Air Djibouti may refuse to accept Baggage for carriage unless it is in our reasonable opinion properly and securely packed in suitable containers
6.4.4 Air Djibouti may refuse to carry Baggage if in excess to the free baggage allowance or unfit for the cabin or for which the excess baggage charges are not paid.
6.5 RIGHT OF SEARCH For reasons of safety and security Air Djibouti may request that passenger permit a search and scan of passenger person and a search, scan or x-ray of passenger Baggage. If passenger are not available, passenger Baggage may be searched in passenger absence for the purpose of determining whether passenger are in possession of or whether passenger Baggage contains any item described in 6.3 or any firearms, ammunition or weapons, which have not been presented to us. If passenger are unwilling to comply with such request Air Djibouti may refuse to carry passenger and his/her Baggage. In the event a search or scan causes Damage to passenger, or an x-ray or scan causes damage to passenger Baggage, Air Djibouti shall not be liable for such damage
6.6 CHECKED BAGGAGE
6.6.1 All checked Baggage must have passenger name or other personal identification affixed to it
6.6.2 Checked Baggage will be carried on the same aircraft as passenger, unless Air Djibouti decide for safety, security or operational reasons to carry it on an alternative flight. The passenger upon arrival at the destination airport must collect all such checked baggage.
6.6.3 If passenger have Baggage in excess of passenger free Baggage Allowance, Air Djibouti will endeavor to carry it subject to payment by passenger of the applicable extra charge. Air Djibouti will endeavor to carry passenger excess Checked Baggage on the same flight as passenger if there is suitable space available on the aircraft but, if Air Djibouti decide for safety, security or operational reasons to carry passenger excess Checked Baggage on a subsequent flight, Air Djibouti will notify passenger. In these circumstances, passenger must make own arrangements to collect the Checked Baggage from the airport at the point of destination.
6.6.4 Air Djibouti do not permit to receive or carry the Baggage by person who is not the owner of that baggage.
6.7 UNCHECKED BAGGAGE
6.7.1 Air Djibouti allows upto maximum weight of 7kgs for Unchecked Baggage commonly known as cabin baggage or hand carry, which passenger carry on to the aircraft. Such cabin baggage must be of a size that can easily fit under the seat in front of passenger or in an overhead storage compartment in the cabin of the aircraft. If passenger Baggage cannot be stored in this manner, or is of excessive in weight or is considered unsafe for any reason, it must be carried as Checked Baggage where excess baggage charges may apply if by including it, the total weight goes above the allowance of already checked in baggage
6.7.2 Objects not suitable for carriage in the cargo compartment (such as delicate musical instruments), and which do not meet the requirements in 6.7.1 above, will only be accepted for carriage in the cabin of the aircraft if passenger have given us notice in advance and permission has been granted by us. Passenger may be required to pay a separate charge for this service.
6.8 COLLECTION AND DELIVERY OF CHECKED BAGGAGE
6.8.1 Subject to Article 6.6.2, passenger are required to collect passenger Checked Baggage as soon as it is made available at passenger destination or Transit Point. Should passenger not collect it within a reasonable time, Air Djibouti may charge passenger a storage fee. Should passenger Checked Baggage not be claimed within three (3) months of the time it is made available, Air Djibouti may dispose it off without any liability
6.8.2 Only the owner of the Baggage Check with Baggage Identification Tag is entitled to receiving of the Checked Baggage. Air Djibouti accept no responsibility for checking the identity or authority of the bearer of the Baggage and Baggage Identification Tag or for checking that such person has any right to collection.
6.8.3 If a person claiming Checked Baggage is unable to produce the Baggage Check or Baggage Identification Tag, Air Djibouti will deliver the Baggage to such person only on condition that he or she establishes to our satisfaction his or her right to the Baggage.
6.9 ANIMALS Air Djibouti reserve the right, at our absolute discretion, to refuse to carry any animals (which, for the avoidance of doubt and without limitation, shall include but not limited to birds, pets). If Air Djibouti agree to carry any animal, they will be carried subject to the following conditions:
6.9.1 Passenger must ensure that the animal is properly crated with necessary supplies of food and water and carried in a container complying with any applicable legal requirements and accompanied by valid health and vaccination certificates, entry permits, and other documents required by countries of entry or transit, failing which, it will not be accepted for carriage. Such carriage is subject to additional conditions
6.9.2 If accepted as Baggage, the animal, together with its container and food, shall not be included in passenger free Baggage allowance, but shall constitute excess baggage, for which passenger will be obliged to pay the applicable charges.
6.9.3 Guide dogs accompanying Passengers with disabilities will be carried free of charge in addition to the normal free baggage allowance provided carrying criteria specified in 6.9.1 is duly met.
6.9.4 Where carriage is not subject to the liability rules of the Convention, Air Djibouti is not responsible for injury to or loss, sickness or death of an animal which Air Djibouti have agreed to carry unless Air Djibouti gross negligence is established
6.9.5 Air Djibouti will have no liability in respect of any such animal not having all the necessary exit, entry, health and other documents with respect to the animal's entry into or passage through any country, state or territory. The person carrying the animal is liable to reimburse Air Djibouti any fines, costs, losses or liabilities reasonably imposed or incurred by us as a result
6.10 ITEMS REMOVED BY AIRPORT SECURITY PERSONNEL Air Djibouti will not be responsible for, or have any liability in respect of, articles removed from passenger Baggage by airport security, customs or other authorities.
Article 7: Schedules, delays, cancellation of flights
7.1 SCHEDULES 1. The flight times shown in timetables may change between the date of publication and the date passenger actually travel. Air Djibouti do not guarantee them to passenger and they do not form part of passenger contract with us. 2. Before Air Djibouti accept passenger booking, Air Djibouti will notify passenger of the scheduled flight time in effect as of that time, and it will be shown on passenger Ticket. It is possible that Air Djibouti will need to change the scheduled flight time subsequent to issuance of passenger Ticket. In such cases, Air Djibouti endeavor to notify passenger of any such changes, if passenger’s contact number or email address is available in his/her booking reference. In an event passenger does not agree to fly on revised flight schedule, passenger will be entitled to a refund in accordance with Article 8.2.
7.2 CANCELLATION, REROUTING, DELAYS, ETC
7.2.1 Air Djibouti will take all necessary measures to avoid delay in carrying passenger and passenger Baggage. However, in an event of operational or technical reason where operating Air Djibouti aircraft does not remain possible, Air Djibouti, to fulfill its commitment, may arrange for a flight to be operated on its behalf by an alternative carrier and/or aircraft.
7.2.2 Except as otherwise provided by the Convention or applicable local law on compensation and assistance to passengers in the event of denied boarding and of cancellation or long delay of flights, if Air Djibouti cancel a flight, fail to operate a flight reasonably according to the schedule, fail to stop at passenger destination or Transit Point destination, or cause passenger to miss connect flight (on a flight operated or confirmed by us) on which passenger holds a confirmed reservation, Air Djibouti shall, at passenger option, either:
7.2.2.1 Carry passenger at the earliest opportunity on another of our scheduled services on which space is available without additional charge and, where necessary, extend the validity of passenger Ticket; or
7.2.2.2 Within a reasonable period of time re-route passenger to the destination shown on passenger Ticket by our own services or those of another carrier, or by other mutually agreed means and class of transportation without additional charge. If the fare and charges for the revised routing are lower than what passenger have paid, Air Djibouti shall refund the difference; or
7.2.2.3 Make a refund in accordance with the provisions of Article 8.2
7.2.3 Upon the occurrence of any of the matters set out in Article 7.2.2, except as otherwise provided by the Convention, or applicable local law on compensation and assistance to passengers in the event of denied boarding and of cancellation or long delay of flights, the options outlined in Article 7.2.2.1 to 9.2.2.3 are the sole and exclusive remedies available to passenger and Air Djibouti shall have no further liability to passenger
7.2.4 If Air Djibouti is unable to provide previously confirmed space, Air Djibouti shall provide compensation to those Passengers denied boarding in accordance with the applicable law.
Article 8: Refunds
8.1 Air Djibouti will refund a Ticket or any unused portion, in accordance with the applicable fare rules or Tariff, as follows:
8.1.1 Except as otherwise provided in this Article, Air Djibouti is entitled to make a refund either to the person named in the Ticket or to the person who has paid for the Ticket, upon presentation of satisfactory proof of such payment.
8.1.2 If a Ticket has been paid for by a person other than the Passenger named in the Ticket, and the Ticket indicates that there is a restriction on refund, Air Djibouti shall make a refund only to the person who paid for the Ticket, or to that person's order.
8.2 INVOLUNTARY REFUNDS
8.2.1 If Air Djibouti cancel a flight, fail to operate a flight reasonably according to schedule, fail to stop at passenger destination or Transit Point, or cause passenger to miss a connecting flight (a flight operated or confirmed by us) on which passenger hold a reservation, the amount of the refund shall be:
8.2.1.1 If the ticket is fully unutilized, an amount equal to the fare paid;
8.2.1.2 If a portion of the Ticket has been used, not less than the difference between the fare paid and the applicable fare for travel between the points for which the Ticket has been used
8.3 VOLUNTARY REFUNDS
8.3.1 If passenger are entitled to a refund of passenger Ticket for reasons other than those set out in 8.2, the amount of the refund shall be:
8.3.1.1 If the ticket is fully unutilized, an amount equal to the fare paid, less any reasonable service charges or cancellation fees.
8.3.1.2 If a portion of the Ticket has been used, an amount equal to the difference between the fare paid and the applicable fare for travel between the points for which the Ticket has been used, less any reasonable service charges or cancellation fees.
8.4 RIGHT TO REFUSE REFUND
8.4.1 Air Djibouti may refuse a refund where application is made after the expiry of the validity of the Ticket.
8.4.2 Air Djibouti may refuse a refund on a Ticket which has been presented to us, or to Government officials, as evidence of intention to depart from that country, unless passenger establish to our satisfaction that passenger have permission to remain in the country or that passenger will depart from that country by another carrier or another means of transport.
8.4.3 Air Djibouti may refuse a refund in the circumstances mentioned in Article 5.2.
8.5 CURRENCY Air Djibouti reserve the right to make a refund in the same manner and the same currency in which the ticket payment was actually made
8.6 BY WHOM TICKET REFUNDABLE Voluntary refunds will be made only by the carrier that originally issued the Ticket or by its agent if so authorized.
Article 9: Conduct aboard aircraft
9.1 GENERAL If, in our reasonable opinion, passenger conduct aboard the aircraft is so as to endanger the aircraft or any person or property on board or obstruct the crew in the performance of their duties, or fail to comply with any instructions of the crew including but not limited to those with respect to smoking, alcohol or drug consumption, or behave in a manner which causes discomfort, inconvenience, damage or injury to other passengers or the crew, Air Djibouti may take such measures as Air Djibouti deem reasonably necessary to prevent continuation of such conduct, including restraint. Passenger may be disembarked and refused onward carriage at any point, and may be prosecuted for offences committed on board the aircraft.
9.2 PAYMENT OF DIVERSION COSTS If, as a result of conduct by passenger of the sort mentioned in Article 9.1 Air Djibouti decide, in the exercise of its reasonable discretion, to divert the aircraft for the purpose of offloading passenger and / or passenger Baggage, passenger in such cases is liable to pay all costs resulting from that diversion
9.3 ELECTRONIC DEVICES For safety reasons, Air Djibouti may forbid or limit operation aboard the aircraft of electronic equipment, including, but not limited to, cellular telephones, laptop computers, portable recorders, portable radios, CD, DVD and MP3 players, electronic games or transmitting devices, including radio controlled toys and walkie-talkies. Operation of hearing aids and heart pacemakers is permitted.
9.4 ON BOARD ALCOHOL Passengers are not allowed to consume alcohol aboard an aircraft whether purchased as duty free from us or someone else or otherwise obtained.
Article 10:Arrangements for additional services
Air Djibouti, while making arrangements for passenger with any third party to provide any services other than carriage by air, or issuing ticket or voucher relating to transportation or services (other than carriage by air) provided by a third party such as hotel reservations or car rental, in doing so Air Djibouti act only as passenger agent. The terms and conditions of the third party service provider will apply and Air Djibouti shall have no liability to passenger for such arrangements.
Article 11: Administrative formalities
11.1 GENERAL
11.1.1 Passenger are responsible for obtaining all required travel documents and visas and for complying with all laws, regulations, orders, demands and travel requirements of countries to be flown from, into or through which passenger transit.
11.1.2. Passenger must obey all laws, regulations and orders of any countries passenger fly from, enter or travel through or in which passenger is in transit
11.1.3 Air Djibouti shall not be liable for the consequences to any Passenger resulting from his or her failure to obtain such documents or visas or to comply with such laws, regulations, orders, demands, requirements, rules or instructions.
11.2 TRAVEL DOCUMENTS Prior to travel, passenger must present all exit, entry permissions, health and other documents required by law, regulation, order, demand or other requirement of the countries concerned, and permit us to take and retain copies thereof. Air Djibouti reserve the right to refuse carriage if passenger have not complied with these requirements, or passenger travel documents do not appear to be in order.
11.3 REFUSAL OF ENTRY If passenger is denied entry into any country, passenger will be responsible to pay any fine, charge or penalty assessed against the carrier by the Government concerned and for the cost of transporting passenger from that country. The fare collected for carriage to the point of refusal or denied entry remains nonrefundable.
11.4 PASSENGER RESPONSIBLE FOR FINES, DETENTION COSTS, ETC. If Air Djibouti is required to pay any fine, charges, fees or penalty or to incur any expenditure by reason of passenger failure to comply with laws, regulations, orders, demands or other travel requirements of the countries concerned or to produce the required documents, passenger shall reimburse us on demand, any amount so paid or expenditure so incurred. Air Djibouti may apply towards such payment or expenditure the value of any unused carriage on passenger ticket, or any of passenger funds in our possession
11.5 CUSTOMS INSPECTION If required, passenger shall attend inspection of passenger Baggage, by customs or other Government officials. Air Djibouti is not liable to passenger for any loss or damage suffered by passenger in the course of such inspection or through passenger failure to comply with this requirement.
11.6 SECURITY INSPECTION Passenger shall submit to any security checks by Governments, airport officials, Carriers, handling agents, police or military officials.
Article 12: Successive carriers
Carriage performed by Ai Djibouti and other Carriers under one Ticket or a Conjunction Ticket is regarded as a single operation for the purposes of the Convention.
Article 13: Liability for damage
13.1 APPLICABILITY Air Djibouti shall be liable only for Damage occurring during carriage performed by us. The liability of each carrier involved in passenger journey will be determined by its own conditions of carriage. Our liability provisions are as follows:
13.2 APPLICABLE LAWS Air Djibouti liability for the carriage of Passengers and baggage is governed by the Convention. This clause 13 sets out the limits on our liability and summarizes the liability rules applied by us under the Convention but if it is inconsistent with the Convention or other applicable laws, the Convention or other applicable laws will override this clause.
13.3 DEATH OF OR INJURY TO PASSENGERS
13.3.1 Our liability for damages sustained in the event of death, wounding or any other bodily injury by a Passenger in the event of an accident shall be subject to a financial limit.
13.3.2 For international carriage any damages up to and including the sum of the equivalent of 113,100 Special Drawing Rights, Air Djibouti shall not exclude or limit its liability.
13.3.3 Notwithstanding the provisions of Article 13.3.2, if Air Djibouti prove that the damage was caused by, or contributed to by, the negligence or other wrongful act or omission of the injured or deceased Passenger or the person claiming compensation, Air Djibouti may be exonerated wholly or partly from our liability in accordance with applicable laws.
13.3.4 To the extent that damages under clause 13.3 may potentially exceed 113,100 Special Drawing Rights they will be reduced accordingly if Air Djibouti prove that damage was not due to gross negligence or willful wrong act or omission by Ai Djibouti or our agents or that the damage was solely due to the negligence or other wrongful act or omission of a third party.
13.4 DAMAGE TO BAGGAGE.
13.4.1 Air Djibouti is not liable for damage to Unchecked Baggage unless the damage was caused by its negligence or the negligence of its agents
13.4.2 Air Djibouti liability for loss or damage to passenger Baggage, including damage caused by delay is limited to 20 United States Dollar per kilogram or limited up to an amount of 1,131 Special Drawing Rights by the Montreal Convention where applies.
13.4.3 If passenger complete a special declaration of higher value (also known as an excess valuation) at check-in and pay the applicable fee, our liability shall be limited to the declared value.
13.4.4 If the weight of passenger checked Baggage is not recorded on the Baggage Check, it is presumed that the total weight of the Checked Baggage does not exceed the applicable free baggage allowance for the class of carriage.
13.4.5 Air Djibouti is not liable for damage to baggage caused by delay if Air Djibouti prove that Air Djibouti and our agents took all reasonable measures to avoid the damage.
13.4.6 Air Djibouti is not liable for any damage caused by Baggage. Passenger are responsible for any damage caused by his/her Baggage to other persons or property, including Air Djibouti property or property of its agents.
13.4.7 Except where the Convention applies, Air Djibouti shall have no liability whatsoever for damage to articles not permitted to be contained in Checked Baggage under Article 6.3.
13.5 GENERAL
13.5.1 If Air Djibouti issue a ticket or if Air Djibouti check Baggage for carriage on another Carrier, Air Djibouti do so only as agent for the other Carrier. For lost or damaged baggage, a claim is to be filed with respective carrier.
13.5.2 Air Djibouti is not liable for any damage arising from its compliance with or passenger failure to comply with applicable laws or Government rules and regulations.
13.5.3 Except as may be specifically provided otherwise in these Conditions of Carriage, Air Djibouti shall be liable to passenger only for recoverable compensatory damages for proven losses.
13.5.4 Nothing in these Conditions of Carriage shall waive any exclusion or limitation of Air Djibouti liability under the Convention or applicable laws unless otherwise expressly stated.
13.5.5 Air Djibouti is not responsible for any illness, injury or disability, including death, attributable to passenger physical or mental condition or for the aggravation of such condition.
Article 14: Time limitation on claims and actions
Acceptance of Baggage by the bearer of the Baggage Check without complaint at the time of delivery is sufficient evidence that the Baggage has been delivered in good condition and in accordance with the contract of carriage, unless passenger prove otherwise. If passenger wish to file a claim or an action regarding Damage to Checked Baggage, passenger must notify us as soon as passenger discover the Damage, and at the latest, within three (3) Days of receipt of the Baggage.
Article 15: Other conditions
Carriage of passenger and passenger Baggage is provided in accordance with regulations and conditions applying to or adopted by us. These regulations and conditions as varied from time to time are important. They concern among other things: 1. The carriage of unaccompanied minors, pregnant women, Passengers with reduced mobility and sick Passengers. 2. Restrictions on use of electronic devices and items
Article 16: Interpretation and modification
The title of each Article of these Conditions of Carriage is for convenience only, and is not to be used for interpretation of the text.
Privacy Policy
The way Air Djibouti use passenger data Air Djibouti may use the data passenger provided for one or more of the following purposes:
1. To confirm passenger travel arrangements.
2. To contact passenger regarding passenger enquiries.
3. To update passenger about flight schedules or changes.
4. For our own marketing purposes, such as sending passenger updates on our latest offers and promotions.
5. To provide passenger with a range of personalized services. The type of personal information Air Djibouti collect about passenger depends on how passenger use the website; and
6. Records of any emails or other correspondence that passenger send via the website.
7. For identification and verification purposes.
8. For our own reference and record.
9. For use in the operation and marketing of any other Business Partners of Air Djibouti. These third party service providers may send passenger emails and/or text messages on behalf of Air Djibouti. These third party service providers may also use passenger personal information that Air Djibouti provide them with to enter into contracts with passenger for the provision of goods and services which passenger may from time to time wish to purchase.
Passenger data may also be used for the following purposes:
- Accounting, billing and audit, credit or other payment card verification, immigration and customs control, security, administrative and legal purposes, Frequent flyer program, systems testing, maintenance and development, customer relations and to help us in any future dealings with passenger such as identifying passenger requirements and preferences.
- For these purposes, Air Djibouti may disclose passenger data to any of the following: Airlines and other companies involved in providing passenger travel or related services and facilities, data processing companies working on our behalf, travel agents, government and law enforcement agencies and credit and charge card companies.
- However, Air Djibouti is not liable for any third party's action in this regard. Passenger will occasionally receive emails about fare sales, special offers, new services and other noteworthy news items. Air Djibouti hope passenger will find these updates interesting and informative
. Other than the above, Air Djibouti will not disclose passenger personal information without passenger consent unless disclosure is either necessary to prevent a threat to life or health, authorized or required by law, reasonably necessary to enforce the law or necessary to investigate a suspected unlawful activity.
